User Service Agreement
【NOTE】The User Service Agreement (hereinafter referred to as "this Agreement") is a legal agreement for you to use the game products and services of the game service provider (hereinafter referred to as "we"). We will remind you of the terms and conditions of this Agreement that are (may be) significantly related to your rights and interests (including the terms and conditions that exclude our liability, the terms and conditions that limit your rights, the terms and conditions of dispute resolution and the terms and conditions of jurisdiction) by using bold font, so please pay attention to the key points. Please make sure you have read carefully, fully understood and accepted all the terms of this agreement without reservation before using the game service.
Unless you have read and accepted all the terms and conditions of the Agreement, you are not entitled to use the Game Services. When you install, use, register or otherwise access our services, or click to agree to the Privacy Policy, you shall be deemed to have read and understood all the contents of the Agreement in detail and agreed to comply with the provisions of the Agreement. Therefore, please make sure you read this Agreement carefully and completely before clicking on the operation.
For any changes to this Agreement, you will be notified by a pop-up window. The Terms of Service will effectively replace the original terms once they are published without further notice to the user. If you do not agree with the changes to the TOS, you should stop using or actively cancel the relevant services, otherwise any login, viewing and other actions of the relevant services will be regarded as your understanding and acceptance of the changes to the TOS and the relevant modified terms.
You acknowledge that you have the appropriate capacity to agree to and comply with this Agreement and that you are solely responsible for all of your actions under this Agreement. If you do not have the capacity to act as described above, you should obtain the informed consent of your legal guardian. If you are not yet 18 years of age, please read and determine whether you agree to this Agreement with a legal guardian, paying particular attention to the terms and conditions for minors. The exercise and performance of the rights and obligations of minors under this Agreement are deemed to be approved by their legal guardians.
I. Introduction of terms
1. Definitions
Unless otherwise specified, the following terms in this Agreement are defined as follows.
1.1 This/the Agreement: refers to the body of this Agreement, the Game Rules, the Privacy Policy, the policy agreements related to minor users such as the User Guide and the Warning Statement, and the modified versions of the above documents. Once the above contents are officially published, they are an inseparable part of this Agreement.
1.2 Game rules: refers to the user rules, player rules, game announcements and notices about the game issued and revised by the game service provider on a regular basis.
1.3 Game Service Provider: also referred to as "we" in this Agreement, refers to the person or company that provides the Game and its services to you.
1.4 Games: means the general term for the games operated by the Game Service Provider, including games in the form of computer games, web games, mobile games, etc.; the games may be provided in the form of software, in which case the games also include related software and related files.
1.5 Game Services: refers to all kinds of network operation services related to the Games provided to you, including but not limited to community services related to the Games.
1.6 Game Components: refer to the content and information contained in the Game, such as text, images, audio, video, icons, interface design, layout framework, related data or electronic documents.
1.7 You: also called "Player" or "User", means a natural person who has the right to use the provided products and services.
1.8 Game data: refers to all kinds of data recorded by the server during the use of the game, including but not limited to game logs, security logs, etc.
1.9 Illegal top-up: means any top-up channel other than Apple App Store payment channel for medium top-up.
1.10 Virtual items: including but not limited to virtual currency, items, equipment, materials, etc. in the game.
1.11 User Information: relates to information registered in your real name registration system, game data in your game account and other information and data provided by you during your use of the game services or information that needs to be collected based on such considerations as security and user experience optimization.
2. Declaration of intellectual property rights
2.1 We are entitled to the intellectual property rights of the Game itself and the Game components (including, but not limited to, all elements of UI design, software code, text, software, sound, images, etc. provided in our Games) and all related proprietary rights, except for the rights of third party rights holders in accordance with legal provisions or other agreements. You may not use the Games for commercial purposes in any way without the prior written consent of the Game Service Provider.
2.2 You have the right to delete the game data under the device when using the game service. However, the ownership and intellectual property rights of the game data such as account data information, character data information, level, ranking data and virtual item data information generated by you in using the game service shall belong to us and be managed by us, and we shall have the right to display the game data of the player within the game and the right to exercise power over such game data.
2.3 This Agreement shall not be deemed to license or transfer to you any rights or interests in relation to the Game and Game Components.
2.4 You shall use the intellectual property rights enjoyed by third parties to which the Game and Game Components may relate in the manner agreed in this Agreement, and if such third parties have other requirements for your use of such intellectual property rights in the Game based on this Agreement, we will inform you of such requirements in an appropriate manner, and you shall comply with them together. If you infringe the intellectual property rights of any third party due to your violation of the provisions of this Agreement or your other unilateral reasons, you shall bear the responsibility and compensate the damage caused by it.
2.5 We respect intellectual property rights and pay attention to the protection of the rights of users. In the game service, you may need to provide us with content by uploading, posting and other means. In such cases, you remain entitled to the full intellectual property rights of such content. You hereby expressly agree that we and our affiliates have the right to use, distribute, reproduce and display such content in connection with the Game Services provided by us.
2.6 Other information and content that we first provide to you.
II. User accounts and services
1. Registration and storage of game account
1.1 Acquisition of game account
(1) If you need to use and enjoy the game and game services, you must fully agree to the terms of this agreement, comply with the relevant laws and regulations, and complete the registration process in accordance with the requirements of the registration page, including but not limited to entering the correct basic materials and information. Some regional users promise to register with their true identity, including but not limited to real name authentication in accordance with the requirements of the game and local laws and regulations, and agree to submit the completed information to third-party organizations for verification, and ensure that the materials and information provided are true, complete and valid. Users bear the corresponding legal responsibility for the information provided in accordance with the legal provisions and this agreement.
According to the relevant laws and regulations, we have the right to require you to provide your real identity information and registration information when using the game, and you are obliged to guarantee the authenticity, legality, immediate validity and accuracy of the information provided, and you are obliged to bear the legal responsibility for all the information provided. You understand and agree that if you fail to fulfill the above obligations, we have the right to refuse to provide you with all or part of the services, and the adverse consequences and any legal liability arising therefrom shall be borne by you.
(2) If you refuse to provide the corresponding materials and information as required, or if the materials and information provided do not meet the requirements, we have the right to refuse to provide the relevant services or assume any obligations. If there is any change in the materials and information provided by you, you should update it in time and we will provide the service in time. If you cannot prove your valid identity because the game account information has changed but not modified in time, we have the right to refuse to provide any information or assume any obligation.
(3) You only have the right to use the game account you created, including withdrawing and deleting the game account. However, you shall be deemed to know and agree that you are responsible for problems caused by game experience or data synchronization failure or game update failure, etc.
(4) If you choose to log in the game through "Quick Game", "Guest" or other similar convenient ways (hereinafter referred to as "shortcuts") without registering an account, please Bind your account in time. If you do not bind your account, once you uninstall or reinstall the game, or your terminal device (including operating system, etc.) is damaged, the game cannot be started normally, all your game data deleted in Quick Mode will not be able to be checked or recovered. If this causes any loss to you, you will bear the corresponding responsibility.
(5) You fully understand and agree that we have the right to audit the authenticity and validity of the identity information provided by you during registration, and have the right to take reasonable measures through technology and management to ensure the security and validity of your game account. The real name registration information of some regional users will be used in the anti-addiction system in accordance with the relevant requirements, i.e. the information can be used to determine whether you are over 18 years old and thus decide whether to impose anti-addiction restrictions on you.
(6) If you use other people's information to register, log in to our games or make third party payments, you will be responsible for all legal responsibilities arising from this. If we discover that the account or account information you use is owned by someone else, we have the right to refuse to provide you with any business, but we are under no obligation to review and monitor all accounts, all access to the Services, IP addresses, online communications, and all content submitted for or included in the Services.
We reserve the right, in our sole discretion, to delete, suspend or terminate access to any Account and/or any Account and/or Content that we deem objectionable for any reason or in violation of any of these Terms, without notice and without liability.
1.2 Use and Maintenance of User Accounts
(1) You are obligated to keep your Game Account and related password in a safe place and to use your Game Account and password correctly and securely. The game account registered by you under this Agreement is only used for your personal entertainment or consumption purposes. You have rights and obligations according to law for your game account held by you after logging in. You may not share your game account with third parties, transfer your game account to others, request game upgrades, etc. If you fail to keep your account and password properly, or fail to use your account and password correctly and securely, any legal responsibility caused by the loss or theft of your account and password and the violation of your and others' civil rights shall be borne by you.
(2) You should notify us immediately when you learn that your account or password has been used illegally, stolen or in an abnormal situation, and you have the right to notify us to take measures to suspend the login and use of the game account.
(3) If we need to take measures to suspend the login and use of your user account according to your notice, we have the right to ask you to provide and verify the relevant information. If you do not provide valid verification information or the verification information is incorrect, we have the right to refuse your request to suspend the login and use of your game account, and you will be responsible for any damage caused as a result.
(4) You shall fully understand and agree that in order to improve the security level of the game service, we have the right to apply relevant technology or software to the game, but we do not guarantee that these security measures can completely prevent the risk of theft or loss of game account.
(5) You shall fully understand and agree that if the use of your game account is restricted, frozen or terminated according to the relevant business rules, it may lead to the deletion of the game data and related information under your game account, and the related rights and interests arising therefrom shall be borne by you, and we shall not be responsible for it.
(6) You should fully understand and agree that we send you product promotion, game service or other related business information by SMS or other means. If you want to stop receiving push messages, you can contact us through the contact information published on the official website to inform us of the cancellation request, and the developer will verify and cancel the push.
(7) You shall fully understand and agree that in order to effectively use the server resources, we have the right to notify, delete or dispose of the game account and related game data and information in advance when necessary and without your use. A game account can be logged into the game for a long time. The above disposal may lead to the loss of relevant rights and interests under the game account, for which we do not assume any responsibility.
(8) You fully understand and agree that if you disclose your property account, bank card, credit card and the corresponding password and other important data and information to others in the process of using the game service, you shall bear any loss caused by it.
2. Games and Game Services
2.1 You may only use the Games and Game Services for non-commercial purposes by.
(1) receiving, downloading, installing, launching, upgrading, logging in, displaying, running and/or taking screenshots of the Games.
(2) creating game characters, setting screen names, viewing game rules, user personal information, game match results, setting game parameters, using chat and social sharing features, purchasing, using, giving away virtual items through legal channels in the game, etc.;
(3) use one or more other features supported and permitted by the Game.
Any other form of unauthorized installation, use, access, display, operation and transfer by you will be considered a violation of this Agreement.
2.2 You may not record and distribute the Game Content to others in any way, including using any third party software for network distribution, without permission.
2.3 With respect to the Software provided, you shall also comply with this Agreement with respect to the download and installation of the Software when using the Games and Services.
2.4 If we find or receive reports or complaints from others that you have violated this Agreement, we have the right to remove the relevant content at any time without notice and impose penalties depending on the behavior, including but not limited to warning, restricting or prohibiting the use of all or part of the functions, prohibiting or even canceling the game account, and the results will be notified.
2.5 You fully understand and agree that we have the right to impose penalties based on reasonable judgment for violations of relevant laws and regulations or the provisions of this Agreement, to take appropriate legal action against any user who violates laws and regulations, and to keep relevant information as evidence. All legal responsibilities arising therefrom shall be borne by the user.
2.6 You shall fully understand and agree that any claims, demands or losses made by third parties as a result of your violation of the provisions of this Agreement or the relevant terms of service shall be borne by you alone, and any losses resulting therefrom shall be borne by you. The game service provider who suffers loss accordingly shall be entitled to hold you liable for compensation.
2.7 You shall fully understand and agree that Virtual Items are part of the Game Services and you are hereby permitted to obtain the right to use them in accordance with this Agreement. Your purchase and use of Virtual Items shall be in accordance with the requirements of this Agreement and the specific rules of the Game; at the same time, Virtual Items may be subject to a certain expiration date. If you do not use them within the specified expiration date, they will automatically expire upon expiration, except for force majeure or attributable reasons.
2.8 You shall fully understand and agree that in order to create a fair and healthy game environment, we have the right to understand your relevant terminal equipment information through technical means during your use of the game service. Once we find any unauthorized program that endangers the normal operation of the game service, we will collect all relevant information and take reasonable measures.
2.9 You shall fully understand and agree that you shall pay the corresponding fees on demand when you use the paid functions of the game. Moreover, these rights are commercial autonomy, which means that we reserve the right to change the business model at any time, i.e. the right to change the fee rate, the fee software function, the fee object and the fee time. We also reserve the right to upgrade, modify, add, delete, modify, change game features or rules. If you do not accept such changes, you shall immediately stop using the game service; your continued use of the game service shall be deemed as your acceptance of the changed business model.
2.10 You shall fully understand and agree that we have the right to periodically transfer or erase part of the past game data stored on the game server in order to ensure the game speed of you and other users.
2.11 You shall fully understand and agree that the game service you use involves internet service and may be affected by unstable factors in various aspects of the internet. Therefore, there is a risk that the game service may be interrupted or unable to meet the user's requirements due to force majeure, virus or hacker attack, system instability, user positioning, user shutdown and any other technical, internet, communication line and other reasons.
In view of this, to the maximum extent permitted by applicable law, we do not guarantee that the game services provided will necessarily meet your requirements or that the game services provided will not be interrupted, nor do we guarantee the timeliness and safety of the game services, the occurrence of errors and whether information can be delivered accurately, timely and smoothly will not be guaranteed.
2.12 You shall fully understand and agree that there is a risk of threatening, defamatory, offensive or illegal content or conduct from others or anonymous or false information that infringes the rights of others (including intellectual property rights) when using the Game Services and that the above risk is borne by you. we disclaim all warranties, express or implied, with respect to the game services, including all related information regarding implied warranties and conditions of authenticity, merchantability, fitness for a particular purpose, title, and non-infringement. We shall not be liable for any direct, indirect, incidental, special and consequential damages arising out of your improper or unlawful use of the Service.
2.13 You should fully understand and be aware of the following.
(1) The Application may be updated periodically through the release of software upgrade packages or software patches, online upgrades, etc. During the update process, personal information such as your game client software version may be retrieved and collected, and will be automatically replaced, modified, deleted and/or supplemented. Such actions are necessary operations or steps for software updates. If you do not agree to such actions, please do not update; your use of the update is deemed to be your agreement to such actions.
(2) For games, partial updates are updates to the software version. If you do not perform such updates, you will not be able to log into the application. Moreover, such an update will cause the original software version on the terminal you are using to be completely replaced by the new software version.
(3) The measures taken due to the user's violation of this Agreement or laws and regulations may lead to the expiration of the virtual items under your current game account, and their service life within the period of taking certain measures, and the loss of the resulting consequences shall be borne by you. That is, the duration of the above-mentioned measures is counted in the life of the virtual items; and the life of the virtual items will not be restored accordingly after the termination of the implementation of these measures.
2.14 Customer service instructions for game rules, bugs (also known as bugs, defects, etc.) or hang-up complaints, game prop retrieval, game prop locking or unlocking, account complaints, etc. can be provided through the official application website, customer service phone, game administrator or other channels, and should have the following conditions.
(1) You have understood the content, requirements and tariffs of these customer services through the official customer service website or other channels provided, carefully selected whether you need to enjoy the corresponding customer services, and truly and accurately expressed your needs.
(2) You have agreed to and accepted the special agreement or terms regarding such customer service.
(3) You have truthfully provided your relevant registered account information and game situation in accordance with the customer service requirements, as well as the situation of other users or the online game itself that you are aware of, such as your account and related information, online game login status and game props situation, bugs (also known as bugs, defects, etc.) in the application, plug-ins, and other bugs (also known as bugs, defects, etc.) or plug-ins that you have found that players have used.
2.15 We have the right to stop or interrupt the services provided by the game server and shall not be liable for any inconvenience or damage caused to users or third parties when one of the following circumstances occurs.

(6) Force majeure and other third-party reasons.
3. User Commitment and Management
3.1 You shall fully understand and agree that you are responsible for all your actions under your Game account, including any content you post and any consequences arising therefrom. You shall judge the game content by yourself and bear all risks arising from the use of the game services, including risks arising from reliance on the correctness, completeness or usefulness of the game content. The Game cannot and will not be liable for any loss or damage arising from such risks.
3.2 Except for using the game services in accordance with the provisions of this Agreement, you shall not engage in any acts that infringe the intellectual property rights related to the game and the game components, or conduct other acts that harm the legitimate rights and interests of third parties.
3.3 Except as permitted by relevant laws or as permitted in writing, you shall not, when using the Game Services, do anything including, but not limited to, the following.
(1) Removing all copyrighted information and content from the Games and other copies.
(2) Reverse engineering, reverse compiling, reverse decoding or attempting to find the source code of the Software and using or disclosing such source code to any third party.
(3) Scanning, probing, and testing the game software to detect, find, and search for possible bugs (also known as vulnerabilities, defects, etc.) or weaknesses.
(4) Copy, modify, add, delete, hook up or create any derivative works software of the game software terminal memory or data released during the operation of the game software, the interaction data between the client and the server during the operation, and the system data required for the operation of the software, including but not limited to using plug-ins, plug-ins or third party tools/services that are not legally authorized to access the software and related systems;
(5) Modify or falsify instructions and data in the operation of the Software; add, delete, change the functionality or operational effects of the Software; or operate or distribute to the public the Software and methods used for such purposes, whether or not the foregoing is done for commercial purposes.
(6) using the game and game services through non-developed, unauthorized third-party software, plug-ins, ins, and systems, or producing, distributing, or disseminating non-developed, unauthorized third-party software, plug-ins, ins, plug-ins, and systems
(7) using, renting, lending, copying, modifying, linking, reproducing, compiling, publishing, posting, establishing mirror sites or intercepting web (network) snapshots of the content with intellectual property rights in the game; or providing the same or similar services as the game services to others by setting up servers.

(9) Use the name, trademark or other intellectual property rights of the Game in a manner inconsistent with the provisions of this Agreement.
(10) Any other conduct not expressly authorized.
3.4 If you have the following behaviors in the process of using the game service, you will be temporarily or permanently banned from logging in, and your game account and game data and related information will be deleted, depending on the severity of the case, in accordance with the provisions of this agreement and the relevant game rules. In serious cases, legal responsibility will be pursued for.
(1) Using the game and the service to publish, disseminate, spread, store content that endangers any national security, social stability, or insulting and defamatory, pornographic, violent, causing riots, content moral that violates social order, and any content that violates laws, regulations and policies; or setting screen names, character names, etc. that contain the above content.
(2) Using the game and services to publish, disseminate, transmit, or store content that violates the legal rights of others such as intellectual property rights, trade secret rights, portrait rights, privacy rights, etc.
(3) Performing any acts that endanger network security, including but not limited to: using unauthorized data or accessing unauthorized servers/accounts; unauthorized access to public networks or other terminal systems, deleting, modifying, adding stored information; unauthorized attempts to detect, scan and test weaknesses of "software" systems or networks or other acts that undermine network security; attempts to interfere with or disrupt the normal operation of the "software" system or website, intentionally disseminating malicious programs or viruses; other acts that interfere with or disrupt normal network information services; and falsifying (part of) the names of data packets.
(4) Active or passive scoring, cooperative cheating, use of plug-ins or other cheating software, use of bugs (also known as "loopholes" or "defects", etc.) to obtain improper or illegal benefits, or making plug-ins, cheating software or bugs available to the public through the Internet or other means. (8) Stealing other people's game accounts and game props.
(9) Private trading of game accounts, private trading of game props, game equipment, game coins, etc.
(10) Taking advantage of the possible technical defects or loopholes of the online game system to gain benefits for oneself and others in various forms.
(11) Using all or part of the data and information generated in the course of various paid or free games provided and stored in the game to seek benefits for oneself and others in various forms.
(12) To make public the contents of plug-ins, self-service, proxy, coin exchange, Trojan horses, etc., or to publicly disseminate the above contents.
(13) Unauthorized use of the products and services provided for profit in reality, and other misconduct generally recognized in the industry, whether or not it is explicitly listed in this Agreement.
3.5 Except for the uses set forth in this Agreement, you may not, without permission, do any of the following, and if you need to perform them, please contact us and enter into an electronic or paper agreement with us upon request.
(1) Modify, copy, distribute, rent, publish, translate, compile, adapt and/or reproduce the Game or its various derivative works, or make them publicly available via the Internet or otherwise.
(2) Production, wholesale, sale, publication and/or distribution of derivative works of game adaptations.
(3) Providing services such as testing, bug (also known as "bugs" or "defects") and plug-in tracking reports, advertising article writing and promotion, and game competitive intelligence gathering.
(4) Use of game names, trademarks, etc.
(5) Performing other acts related to the game services other than the above mentioned acts that require the developer's consent.
3.6 If the user violates this agreement or relevant laws and regulations, we have the right to take one or more of the following measures.
(1) Immediately disconnect the network connection between the terminal currently used and the application server, and you must log in again to continue using the application.
(2) Temporarily prohibit you from logging into the online game with the account you are currently using.
(3) Temporarily prohibit you from using a feature of the application that requires payment until the date you pay the fees owed, and pay the corresponding fees in advance for the continued use of said paid feature.
(4) Reduce or remove points, levels and/or honors from your account that you are currently using in the Application.
(5) Temporarily prohibit you from posting any comments in the online game under the account you are currently using.
(6) Permanently and irrevocably delete any advertisements, false information or illegal statements posted by you or take other measures to prevent their dissemination.
(7) Permanently and irrevocably delete game props such as virtual currency, game props and/or game equipment that you have obtained illegally, or return them to other users who have obtained the right to use them through legal means.
(8) Permanently and irrevocably cancel or remove your illegally obtained points, achievements and/or honors.
(9) Permanently and irrevocably prohibit you from posting any comments in the application using the account you are currently using.
(10) Permanently and irrevocably delete all game props, game equipment, game coins, points, ranks, honors and other information and corresponding game data under your current account.
(11) Permanently and irrevocably prohibit you from logging into the application with the account you are currently using, and delete and erase all data, game coins, items, equipment and other information generated by this account in the application.
(12) To take measures other than those mentioned above.
We may take one or more of the aforementioned measures continuously, intermittently or alternately.
If the same user has any account or role that violates this Agreement and other related regulations, we have the right to sanction all accounts and roles under that user, including but not limited to suspending, terminating, and deleting all accounts and users under that user.
3.6 The User undertakes not to engage in game conduct or trade in virtual items for profit, and any situation in which the User engages in game conduct or trades in virtual items for profit will be deemed to be for improper gain, including but not limited to the User.
(1) Registering multiple user accounts and/or game character IDs to engage in game behavior for profit.
(2) Engaging in in-game play with a single or series of outputs and selling the virtual items obtained for profit.
(3) Taking advantage of the difference in the value of virtual items on different servers to buy and sell virtual items on different servers for profit.
(4) Acting as an intermediary for trading game accounts and virtual items to collect fees for profit.
(5) Trading user accounts or virtual items on trading platforms other than those provided or approved by us for profit.
(6) Using virtual items obtained in the game for selling for profit without paying attention to the improvement of their own character strength, with a large difference between the level of multiple skills, cultivation, equipment and summoned beasts of the character and the character level.
(7) the use of game behavior and game content to organize or participate in gambling, the implementation or participation in the implementation of theft of other people's property or virtual goods and other suspected illegal and criminal acts.
(8) Any other in-game profit-making behavior that is not aimed at the normal interactive needs of game entertainment.
We have the right to take the following measures against users who make improper profits at the same time: reverse deduction of values, recovery of game virtual goods, temporary freezing of play, permanent freezing of play, forced offline, temporary isolation, permanent isolation, account blocking, revocation of transactions, deduction of illegal transaction proceeds, Restrictions on trading functions, deletion of files and other technical measures to prevent users from engaging in such behavior; in case of serious circumstances, we reserve the right to pursue the legal responsibility of the user.
4. Account Termination
We may, in our sole discretion, immediately terminate or suspend your account and disable access to the Services without notice or liability for any reason and without limitation, including, but not limited to, breach of this Agreement.
